After a custody Order or Decree is entered, a parent who wishes to relocate with a child must provide written notification to the other parent. The parent who is not planning on moving then has the opportunity to either consent or petition the court to prevent the relocation of the child. If the parents cannot agree on the relocation of a child, the Court must determine whether the move is in the best interests of the child. The burden of proof is a heavy one and lies with the relocating parent. The Court will look to the factors in A.R.S. §25-408 to determine what’s best for the child. These factors include the reason a parent needs to relocate with the child, and the advantages of the relocation to the child’s life and well-being.
